AUBURN -- A state prison inmate was sentenced in Cayuga County Court Thursday to seven more years in prison for fighting with corrections officers. Judge Thomas Leone also sentenced Camillo Douglas, 26, to five years post-release supervision for three charges of second-degree assault.
Douglas was found guilty by a jury in August of assaulting three officers at Auburn Correctional Facility. The officers were injured trying to subdue him during a strip search, according to Chief Assistant District Attorney Jon Budelmann, who prosecuted the case.
Douglas is currently serving up to 15 years at Clinton Correctional Facility in Dannemora for several felonies committed in the Bronx.
Budelmann had asked for the maximum penalty, which he said was 21 years - seven for each charge. Budelmann argued that the defendant assaulted the officers in three separate, distinct acts, which justifies consecutive prison terms.
Defense attorney Craig Schlanger argued that the injuries were the result of a single struggle, and asked for the minimum sentence of five years.
Leone said that his “hands are somewhat tied” with the sentence. While he stated that the assault was committed “with intent to prevent peace officers from a lawful duty,” the defendant did not throw a punch, slap or pinch anyone, and handed down what he said was the maximum penalty for the conviction.
Also in court:
€ Leone will consider a request by Budelmann that a DNA sample be taken from James Scott, 24, of 144 Van Anden St., Auburn, and used as possible evidence in his upcoming trial. Scott pleaded not-guilty in June to the felonies of second-degree assault and third-degree criminal possession of a weapon.
He is accused of slicing the face of a 17-year-old in March. His trial begins in November.
The sample would be compared with evidence on a knife that is said to have been used in the incident. Leone said he would make his decision concerning the request by next Friday.
€ Leone set a new date to hear the plea of Branden Hackett, 19, of 8469 King St., Port Byron.
Hackett is charged with attempting to engage in unlawful sex with a minor, a Class-E felony.
