AUBURN - A former Boy Scout volunteer received the maximum sentence Tuesday of seven years in prison with 10 years post release supervision for two felony counts of first-degree sexual abuse and two misdemeanor counts of second-degree sexual abuse.
Charles H. Seamans, 46, of 26 Evergreen Lane, Weedsport, a former assistant scoutmaster with the Boy Scouts Cayuga County Council, was convicted in Cayuga County Court May 20 of molesting a 10-year-old and a 14-year-old during Scout related activities between January and February 2007.
With both the victims' families present in court, Cayuga County Judge Mark Fandrich delivered the maximum sentence allowed by law instead of the four-year prison sentence that had been recommended.
“A person like you is really a parent's worst nightmare. You victimized these boys - and you victimized the community,” Fandrich said.
Cayuga County District Attorney Jon Budelmann said Seamans, who was with the Boy Scouts for 10 years, had groomed the victims and their families.
“(Seamans) was in a position of trust as a Scout leader and he abused that trust,” Budelmann said. “He groomed the victims and the community. He gained the trust of the parents and the children and violated that trust.”
Seneca County Chief Assistant District Attorney Dave Mashewske, said Seamans still had charges pending in Seneca County for allegedly sexually abusing a 12-year-old boy during a Scout outing at Camp Babcock Hovey in July 2007.
Seamans is scheduled to appear in Seneca County Court in August where he will either plead guilty to the felony count of a criminal sex act and misdemeanor endangering the welfare of a child, or decide to go to trial, Mashewske said.
If Seamans were convicted in Seneca County, the judge would decide whether or not to have the new sentence run concurrent or consecutive to the prison sentence he received in Cayuga County.
