Nozzolio: Alarming number of prisoners released

This week’s question: The number of felons being paroled in New York rose dramatically last year. Is this a sign of poor oversight or simply a coincidental occurrence? Is a new law changing the way the parole board operates really necessary?

Shockingly, 215 convicted murderers were granted parole last year and released back on to the streets.

This alarming trend of murderers and violent felons being released from prison must be stopped. Throughout my tenure in the state Legislature, I have worked tirelessly to protect our communities and you can be assured that I will not stand by as more and more criminals are released onto the streets.

There are three important provisions that Parole Board members must take into account when deliberating whether an inmate is fit to be paroled. They must factor in the nature of the crime that was committed, the threat the inmate poses to society if released, and the inmate’s rehabilitation record while they have been incarcerated.

The growing number of murderers and dangerous convicts being released clearly indicates a growing disregard by Parole Board members of the heinous nature of the crimes that sent these perpetrators to prison.

Data released by the State Division of Parole shows that violent felons appearing for the first time before the Parole Board in 2007 were released at a rate 180 percent higher than the year before.

In an effort to curb this dangerous trend, I convened the Crime Victims, Crime and Corrections Committee last month to hear testimony from Division of Parole Chairman George Alexander and Division of Criminal Justice Services Director Denise O’Donnell. Unfortunately, their testimony did not offer any tangible reason for the alarming increase in the release of violent felons.

It is apparent that legislative measures must be taken to strengthen New York’s parole policy. This legislative session, I am sponsoring comprehensive legislation that will require a unanimous vote of at least three Parole Board Members for parole to be granted to inmates convicted of a violent felony.

In addition, my legislation will require the Division of Parole to maintain a listing of inmates and their parole eligibility dates on their Web site as well as notify a victim or their family when their perpetrator’s hearing is scheduled so that they can testify as to the harm that has been caused to them.

" Nozzolio is a moron and except for sitting his fat butt on the corrections appropriation funding he has done little for Corrections. I worked for them for 30 years and he's about getting his picture taken and thats it! The throwing bill he takes credit for he had little to do with, once it was apparent that the bill was to become law he made out like he was the primary sponser. The officers union and the lobbyists made this bill happen but Mike took the credit. A word about murders....statistically these are a crime of passion with little chance of happening again.There are exceptions like serial killer. However most wardens around the country will have an inmate assigned to them at every prison and typically they all choose someone with a muder rap! Mike Nozzolio is only looking out for himself. If inmates could vote his whole attitude would change and thats a fact! "

WORK in a correctional facility, READ about the crimes these individuals have committed, SEE first hand how many commit further crimes and return to prison. Being young and stupid is no excuse for the crimes committed whether they knew what was going down or not. Motel 6 . . . we'll leave the light on! "

" What Sen. Nozzolio fails to mention is significant.

1. Of the 215 "convicted murderers" who were released last year, the chances that any of them will commit another crime, let alone murder, are statistically very very low.

2. The Parole Board does not release everyone who has served their minimum sentence. They carefully evaluate each case, and base their decision on evidence of positive rehabilitation. After all, prisons are called correctional facilities for a reason.

3. People in prison, even for murder, did not necessarily commit a heinous crime. Some were young kids trying to gain approval from the older ones, and tagging along on what they only thought was a night's adventure, and had no idea murder was a possible outcome. Some people actually were wrongfully convicted.

4. Senator Nozzolio's statistics often are gained by comparing apples with oranges. Check out the actual statistics before you get as alarmed as he would like.

4. The reason Denise O'Donnell, George Alexander, and Brian Fischer did not offer any tangible reason for the alarming increase in the release of violent felons is likely because more people were convicted 25 - 30 years ago than 30 - 50 years ago. Our population - inside prison and outside - has increased quite a bit in that time.

Senator Nozzolio is not protecting US from anything. He may be trying to protect HIS political career. "
