AUBURN - A local woman who originally faced 15 felony drug related charges pleaded guilty in Cayuga County Court Thursday to one count of attempted sale of a controlled substance, a felony.
Krista Huey, 23, of Auburn, admitted that she attempted to sell cocaine to a confidential informant within city limits in August 2007 for $150.
Citing her lack of criminal history, Leone sentenced Huey to one year in prison with two years of post-release supervision. With credit for time already served, it was estimated Huey may only spend eight months in prison. She will also have to pay $150 in restitution.
“I don't think you're an inherently bad person. I do believe you make inherently bad choices all the time,” Leone said. “From the people you hang around with to the choices you make.”
Cayuga County District Attorney Jon Budelmann said it is believed that Huey had a romantic relationship with her co-defendant, Luyette Wilder, 34 of 14 Grover St., apartment 1, Auburn, who pleaded not guilty on Dec. 23 to four counts of possessing a narcotic drug.
Budelmann previously said Wilder is accused of setting up drug deals while Huey made the actual transactions.
Also in court:
#&149; An Auburn man was sentenced to concurrent prison terms of five years and six years for two separate incidents where he assaulted an Auburn resident and sold drugs to a confidential informant.
Michael Maycumber, 26, of 22 Washington St., will serve the sentences at the same time, and was also sentenced to five years of post-release supervision.
Maycumber will also have to pay $6,051 in restitution to the assault victim and will have to forfeit $1,602 in cash that was seized from him when he was arrested during that incident.
Maycumber said $550 of the seized cash was from his Nucor Steel paycheck, which he was going to use to pay for an apartment, and the rest belonged to his brother.
When he pleaded guilty on Nov. 13, Leone told Maycumber he could keep the money if he could provide paperwork to prove it was not from drug deals.
After Maycumber failed to produce any paperwork, Leone said he would seize the money and turn it over to the Finger Lakes Drug Task Force, but would allow Maycumber to turn over his income tax return to his brother instead of having it collected as restitution.
#&149; A local man will spend one year in jail for stealing a $5 six-pack of beer from Hibiscus Harbor in Union Springs.
Nicholas Barner, 26, of 4327 Route 90, pleaded guilty to third-degree burglary, a felony, and misdemeanor petit larceny on Nov. 6, 2008.
Barner will be credited for time already served and will not be required to pay restitution.
#&149; A local man faces one to three years in prison after he pleaded guilty to driving while intoxicated.
Alan Edwards Sr., 54, of 13446 Route 90, Locke, admitted he had a few drinks before police pulled him over on Route 90 in Locke on Sept. 26. When officers administered a sobriety test, Edwards had a blood alcohol content of .15. The legal limit is .08.
Edwards also admitted he is a second felony offender who was convicted of DWI in Tompkins County in 2000.
Edwards also has DWI convictions in 1996 and 1980. In the 1980 incident, Edwards was also convicted of two counts of negligent homicide.
