THIS ACTION IS SUBJECT TO A PERMISSIVE REFERENDUM. WHEREAS, the District Commissioners have been advised by authorized officers of the Owasco Fire Department that the cement and asphalt in front of Station One has deteriorated to the point it is cracking and crumbling and is in need of replacement as it is original to the 1999 construction of the addition; and WHEREAS, the Fire District, by resolution duly published November 2, 1994, and duly adopted on November 8, 1994, created a Capital Reserve Fund for the purchase of such equipment as cement and asphalt proposed herein; and WHEREAS, the District Commissioners have taken the Fire Department’s advisement into consideration and has deliberated upon such advisement; and WHEREAS, the Commissioners deem the Replacement of said cement and asphalt necessary and just; and WHEREAS, the District received a quote from their RFP and it is of a reasonable estimate; NOW IT BE RESOLVED, that the District hereby agrees with the authorized officers of the Fire Department that the cement and asphalt in front of Station One should be replaced and that the District shall expend not more than the sum of $60,000.00 from the aforementioned Capital Reserve Fund; and it is further RESOLVED, THAT THE District has determined that the proposed project is an unlisted action under the State Environmental Quality Review Act (SEQRA), which will not have a significant effect on the environment and preparation of a draft environment impact statement will not be required. *MOTION PASSED BY VOTE BY Chairman Oxford, Commissioners Messena, DeVoe, and Rickard. Commissioner Cummings having been absent. FURTHER WHEREAS, THE District determined the replacement of the cement and asphalt at Station One is SUBJECT TO PERMISSIVE REFERENDUM PURSUANT TO General Municipal Law Section 6-g(7). NOW IT BE RESOLVED, that although the District determines that this Resolution is deemed to be hereby adopted by the Commission, the District Secretary is hereby directed to publish these Resolutions in their entirety forthwith in order that the provisions hereof shall take full force and effect 30 days hence, unless within said 30 day period there be filed with said District Secretary a petition for Special Election and executed in form and manner prescribed by General Obligations Law Section 6-g(7). *MOTION PASSED BY VOTE BY the Commissioners. THIS ACTION IS SUBJECT TO A PERMISSIVE REFERENDUM.
